Border Timber Products is a trading name of M.A.C. Lofts Pigeon Products, operated by Michael Gillies as a sole trader.
Throughout this document, references to “Border Timber Products”, “we”, “us”, or “our” refer to Michael Gillies trading as M.A.C. Lofts Pigeon Products / Border Timber Products

Welcome to Border Timber Products. By purchasing our products or services, you agree to be bound by the following terms. Please read carefully before placing an order.


1. General Sales Policy

All sales are final. No refunds, returns, or exchanges will be provided.

By completing a transaction, you confirm that you understand and agree to these terms.

These terms apply to all purchases made through our website, in person, or through any official Border Timber Products communication channel.


2. Made-to-Order & Bespoke Products

Generally, All products are made to order. Material orders and production begin shortly after purchase, making cancellations or alterations impossible.

As each item is handmade, slight variations in finish, material, or appearance may occur. These are not considered defects and do not qualify for refunds or returns.

Customers are responsible for ensuring the accuracy of all order details before confirming purchase.


3. Delivery, Risk & Responsibility

3.1 General Delivery Terms

All items are carefully inspected before dispatch.

Delivery dates provided are estimates only. Delays caused by third parties (couriers, pallet networks, supply chains) are outside our control and do not entitle customers to cancel, request modifications, or claim compensation.

Risk passes to the customer at the point of delivery.


3.2 Customer Responsibility After Delivery

Border Timber Products is not responsible for damage caused by mishandling, misuse, improper installation, incorrect storage, environmental exposure, or failure to follow guidance after delivery.


3.3 Pallet Delivery Requirements

Customers must ensure that pallet deliveries can be accepted at the delivery address. This includes:

• Suitable access for a tail lift pallet lorry (up to 16T)
• Adequate space for safe and legal kerbside offloading

Drivers are not required to:

• Move goods beyond kerbside
• Assist with unpacking
• Carry items onto the property
• Dispose of packaging


Restricted Access

If access may be restricted due to:

• Narrow roads
• Steep gradients
• Limited turning space
• Rural locations
• Low bridges or height restrictions

You must notify us immediately upon ordering.

Failed deliveries due to access issues may incur redelivery charges payable by the customer.


Damage at Delivery – Mandatory Signing Procedure

If any visible damage is present on arrival, the PDA (handheld device) must be signed as:

“DAMAGED, DAMAGED – ACCEPTED, DAMAGED RETURNED”

Photographic evidence must be taken at the point of delivery while the driver is present.

If the consignment is signed as “undamaged”, courier insurance cannot be claimed and we cannot accept liability.


Liability Statement

Responsibility for the goods transfers to the recipient at the point of dispatch.

Once your order leaves our premises, Border Timber Products is no longer liable for loss, damage, or deterioration occurring during transit.

All pallets are photographed prior to dispatch as evidence of condition.

These photographs serve as proof that goods left our facility in acceptable condition.

While we will always attempt to assist customers in raising courier claims where possible, Border Timber Products accepts no liability for damage, loss, or delays occurring while goods are in the possession of the courier.

Courier claims cannot be processed if the procedures above are not followed.

Signing for goods as “undamaged”, “OK”, or failing to record damage on delivery paperwork will void any claim.

Failure to follow these procedures will void any courier damage claims.


4. Limited Exceptions

Exceptions may only be considered under the following circumstances:

Damaged on Arrival

If your order arrives damaged, you must notify us in writing within 24 hours of receipt and provide clear photographic evidence.

Incorrect Order Supplied

If we deliver a product that does not match your confirmed order.

Non-Conforming Service

If a service delivered is materially different from the written agreement.

If approved, we may issue a repair or replacement at our discretion.

Refunds will not be offered.


5. Intellectual Property Ownership

All intellectual property associated with Border Timber Products is protected under UK and international law.

This includes but is not limited to:

• Product designs and specifications
• Structural designs and construction methods
• Logos, branding, and trade names
• Photographs, videos, and marketing materials
• Website content and graphics
• Documentation and plans

Customers acquire no intellectual property rights by purchasing our products.


6. Prohibited Uses & Restrictions

You may not under any circumstances:

• Copy or reproduce our designs
• Reverse engineer or replicate our products
• Manufacture or commission copies of our structures
• Resell our products under another brand without written consent
• Use our branding or imagery for commercial gain
• Register trademarks, designs, or patents similar to ours

Violation of these terms constitutes intellectual property infringement.


7. Enforcement & Legal Action

Border Timber Products actively protects its intellectual property.

Where infringement or misuse is identified we may pursue:

• Immediate cease and desist orders
• Injunctions preventing sale or production
• Seizure of infringing goods
• Financial damages for loss of profit and reputational harm
• Recovery of all legal and enforcement costs

We actively monitor marketplaces, online platforms, and social media for infringements.


8. Commissioned Work, Design & Consultation

Requests made to Border Timber Products for:

• Design work
• Bespoke planning
• Quotations and pricing calculations
• Consultations or advice
• Drawings or revisions
• Preparatory work of any kind

constitute a commission of services once work begins.

Requests may be made via:

• Website enquiries
• Email correspondence
• Social media messages
• Telephone conversations
• In-person discussions

No signed contract is required for work to be deemed commissioned.

If you decide not to proceed after such work has begun, the following applies:

• All completed work remains chargeable
• There is no obligation to provide free work
• Non-response does not remove liability for payment

Invoices for commissioned work must be paid within the stated terms.

Failure to pay may result in:

• Suspension of services
• Debt recovery action
• Legal proceedings
• Recovery of administrative and legal costs


9. Right to Refuse or Terminate Service

Border Timber Products reserves the right to refuse service, cancel orders, or terminate transactions where:

• Fraudulent activity is suspected
• Intellectual property risks are identified
• Customers behave abusively or aggressively toward staff


10. Limitation of Liability

Products are sold as described.

No warranties are provided beyond what is legally required.

Border Timber Products shall not be liable for:

• Indirect losses
• Consequential damages
• Loss of profits arising from product use or misuse

Customers are responsible for ensuring products are suitable for their intended use and installation environment.


11. Governing Law

These terms are governed by the laws of Scotland, United Kingdom.

Any disputes shall be resolved exclusively within the Scottish courts.


12. Policy Updates

Border Timber Products reserves the right to update this policy at any time.

Updates will be published on our website with a revised effective date.

Continued use of our services after updates constitutes acceptance of the revised policy.


13. Acceptance of Terms

By placing an order with Border Timber Products, you confirm that you:

• Have read and understood these terms
• Accept all conditions regarding sales, liability, and intellectual property
• Acknowledge that infringement of our intellectual property will result in legal enforcement
